Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the humsafr commute pooling platform, including the mobile application and any associated websites ("the Service"). By registering an account or using any part of the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Service.

2. Who can use humsafr

• You must be at least 18 years old to create an account on humsafr.
• You must possess a valid Pakistan CNIC or equivalent government-issued identity document.
• Drivers must hold a valid Pakistani driving licence and have a vehicle registered in their name or with documented permission to use.
• You may not use the Service if you have been previously suspended or permanently banned from humsafr for a conduct violation.
• You are responsible for keeping your account credentials secure. Do not share your login credentials with any other person.

3. Commute pooling — not a taxi service

humsafr is a commute pooling coordination platform. Drivers on humsafr are private individuals sharing their existing commute route — not professional taxi or ride-hailing operators. The fare paid by riders represents a proportional cost-share of the driver's actual commute, not a commercial fare for transport services.

humsafr does not employ drivers, own vehicles, or provide transport services. We provide the platform that enables commuters to find and coordinate verified pooled commutes.

4. Rider obligations

• Provide accurate personal information and complete the required verification tier for the rides you wish to access.
• Be ready at your confirmed pickup point at the agreed departure time. Repeated late cancellations or no-shows may result in account restrictions.
• Treat drivers and fellow riders with respect. Harassment, discrimination, or threatening behaviour is grounds for immediate account suspension.
• Pay the confirmed fare through the app. Attempting to avoid payment or dispute a valid fare in bad faith is a breach of these Terms.
• Do not share your seat booking with another person or allow an unverified individual to join a pool on your behalf.
• Notify humsafr of any safety concern or incident through the in-app reporting tool or by contacting contact@humsafr.com.

5. Driver obligations

• Complete the required driver KYC before posting any corridor. Providing false or misleading identity documents is a criminal offence and will result in permanent suspension.
• Post only corridors you genuinely intend to drive. Creating fake routes to manipulate the platform is a breach of these Terms.
• Arrive at the pickup point on time and follow the posted corridor. Unilateral route deviations that affect riders require rider consent.
• Maintain your vehicle in a roadworthy condition. You are responsible for holding valid vehicle insurance as required by Pakistani law.
• Do not drive under the influence of alcohol or controlled substances. Violation of this rule will result in permanent suspension and may be referred to law enforcement.
• For women-only routes, comply with all additional verification and operational requirements as communicated by humsafr. Failure to maintain these standards will result in immediate removal from women-only eligibility.
• You are responsible for any applicable tax obligations arising from income earned through the platform.

6. Fares and payments

How fares are set

humsafr calculates suggested fares based on corridor distance, estimated fuel cost, and seat count. Fares represent a fair cost-share, not a commercial rate. You will always see the full fare breakdown before confirming a booking.

Payments and payouts

Riders pay via Raast, JazzCash, Easypaisa, or cash on arrival as specified by the driver's corridor settings. Driver payouts are processed after trip completion via Raast or the driver's preferred wallet. humsafr charges zero platform commission at launch. If the fee policy changes, drivers will receive at least 30 days' advance notice.

Disputes

Fare disputes must be raised within 48 hours of a completed trip. We will review the trip record and communicate a decision within 7 business days. humsafr's decision on fare disputes is final.

7. Safety and emergency

humsafr includes built-in safety features including masked calling, live trip-share to trusted contacts, and an SOS button connected to Rescue 1122. These features are designed to reduce risk, but they do not eliminate it. You use the Service at your own risk.

• If you are in an emergency during a trip, activate the SOS button in the app. It connects to Rescue 1122 and sends your live location to your trusted contacts.
• Report any safety incident after your trip using the in-app reporting tool. humsafr investigates all safety reports and may suspend accounts pending investigation.
• Do not share personal contact details with other users outside the app. All communication should go through the masked relay.

8. Prohibited conduct

The following are prohibited on humsafr and may result in immediate account suspension, permanent ban, and referral to law enforcement:

• Impersonating another person or submitting false identity documents during verification.
• Harassment, abuse, threats, or discriminatory behaviour toward any other user.
• Physical assault or endangerment of any other user during a pool.
• Attempting to circumvent the payment system or defraud another user.
• Using the platform to arrange transport for illegal purposes.
• Scraping, reverse-engineering, or misusing the platform's data or APIs.

9. Platform availability and changes

We aim to keep humsafr available continuously, but we do not guarantee uptime. The Service may be temporarily unavailable for maintenance, updates, or circumstances outside our control. We reserve the right to change, suspend, or discontinue any part of the Service with reasonable notice where possible.

10. Intellectual property

All content, branding, software, and design in the humsafr platform belong to humsafr and its licensors. You may not reproduce, distribute, or use our content for any commercial purpose without written permission.

11. Limitation of liability

humsafr provides a coordination platform. We are not a transport operator and do not accept liability for incidents that occur during a commute pool. To the maximum extent permitted by Pakistani law, humsafr's total liability for any claim arising from use of the Service is limited to the fare amount paid for the specific trip giving rise to the claim.

We are not liable for indirect, incidental, or consequential losses including loss of income, loss of data, or personal injury arising from use of the Service.

12. Termination

You may close your account at any time by contacting contact@humsafr.com. humsafr may suspend or terminate your account at any time for breach of these Terms, for conduct that endangers other users, or for legal compliance reasons. Sections 7, 10, 11, and 13 survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan. Before pursuing formal legal action, we encourage you to contact us at contact@humsafr.com to seek an informal resolution.

14. Changes to these terms

We may update these Terms as the Service evolves. If a change materially affects your rights or obligations, we will notify you via in-app message or email at least 14 days before the change takes effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
